الملخص: يرمي البحث إلى تسليط الضوء على قاعدتين أساسيتين من القواعد التي لهما أثر بالغ في الحكم على كثير من القضايا المعاصرة، وهما قاعدتي: الضرورات تبيح المحظورات"، و"الحاجة تنزل منزلة الضرورة، وتسليط الضوء أيضا على القواعد التابعة لهما، وذلك من خلال كتاب بيان الشرع لأبي عبد الله الكندي، وهو موسوعة فقهية ضخمة، حاول الباحث تتبعها كاملة، واستخراج أبر الفروع الفقهية التي وظف فيها الشيخ هذه القواعد، قصد الوصول إلى إبراز مدى حضور هذه القاعدة في الفروع الفقهية المختلفة التي نقلها، وأيضا، ضوابط العمل بهذه القواعد من خلال تلك الفروع.
ثم سعى الباحث بعد ذلك إلى إبراز أثر تلك القواعد في بعض المسائل المتعلقة بالمعاملات المالية المعاصرة كنماذج، واختار الباحث من تلك المسائل: مسألة القرض الربوي في حال الضرورة أو الحاجة، ومسألة التأمين التجاري الاختياري منه والإجباري، ومسألة العمل في مؤسسات تتعامل بالحرام، محاولا إسقاط ما سبق من قواعد مختلفة على هذه المسائل، للوصول إلى مدى تحقق حالة الضرورة أو الحاجة، وإمكانية الترخص لأجل ذلك، وضوابطه عند ثبوته.

Abstract: The research focuses on two basic rules which have a deep impact on judging many modern issues, those rules are "Necessities allow prohibitions" and "Need comes down to be a necessity", the research also sheds light on the rules that are related to the two previous one through a book, which is a huge jurisprudence encyclopedia, entitled "Bayan Echara" to Abu Abdullah El-Kindi. The researcher tried to follow all of them, and extract the most prominent branches of jurisprudence in which El-Kindi used those rules in order to conclude to which extent that the rule is present in different jurisprudential branches, as well as, the manner of work with these rules through the branches.
After that, the researcher highlighted the impact of these rules on some issues that have relations with modern financial transactions as a model. The issues that were neatly chosen are: Usurious loan in case of necessity or need, The facultative and the forced commercial insurance, Working in institutions gain illegally, so he tries again to link the different previous rules with those issues, to get whether the case is a necessity or need and the possibility of making a concession then making controls for it, if it is proven.

Résumé: La recherche se concentre sur deux règles de base qui ont un impact profond sur le jugement de nombreuses questions modernes, ces règles sont «Les nécessités permettent des interdictions» et «Le besoin devient une nécessité», la recherche met également en lumière les règles qui sont liées aux deux précédentes à travers un livre, qui est une énorme encyclopédie jurisprudentielle, intitulé «Bayan Echara à Abu Abdullah El-Kindi. Le chercheur a essayé de tous la suivre et d'extraire les branches jurisprudentielles les plus importantes dans lesquelles El-Kindi a utilisé ces règles, afin de conclure dans quelle mesure la règle est présente dans différentes branches jurisprudentielles citées, ainsi que la manière de travailler avec ces règles à travers ses branches.
Après cela, le chercheur a montré l'impact de ces règles sur certaines questions qui ont des relations avec les transactions financières modernes comme modèle. Les questions qui ont été soigneusement choisies sont: le prêt usuraire en cas de nécessité ou de besoin, l'assurance facultative et l'assurance commerciale forcée, le travail dans les institutions qui gagne illégalement. Alors il a essayé à nouveau de projeter les différentes règles précédentes sur ces questions, pour savoir si le cas est une nécessité ou un besoin et la possibilité de faire une concession puis d'en faire les contrôles, si elle est prouvée.
